The Law Society of England and Wales has launched a comprehensive practical guide for solicitors, signalling a move towards more rigorous Governance Frameworks around the use of Artificial Intelligence. As the majority of firms now integrate AI into routine document drafting and case analysis, the professional body warns that a lack of human oversight could expose the sector to significant systemic and ethical liabilities.

Mitigation of “High-Risk” Digital Innovation

While acknowledging that the benefits of automation can be “enormous,” the Law Society’s guidance highlights a triad of critical risks: data protection breaches, unreliable or “hallucinated” outputs, and the presence of embedded biases within algorithmic models. The guide serves as a technical manual for firms to navigate the procurement lifecycle—from identifying business needs to contract negotiation and post-implementation evaluation.

To support this transition, the Society has released a suite of downloadable templates designed to standardise the “briefing” and “supplier selection” phases. This move aims to ensure that Digital Innovation within the legal sector is underpinned by professional standards rather than vendor-led excitement.

The new resource outlines a structured methodology for adopting new technology:

  • Need Identification: Aligning tools with specific institutional requirements.
  • Supplier Diligence: Establishing criteria for vetting AI and software providers.
  • Human-in-the-Loop Requirements: Reaffirming that human oversight is a non-negotiable ongoing requirement, not an optional final check.
  • Contractual Safeguards: Ensuring liability and data sovereignty are clearly defined during negotiations.
